Understanding the Causes of T-bone Accidents
Most T-bone accidents can be explained simply: A driver runs a red light and hits a vehicle legally in the intersection. But even where there is no traffic signal, Nevada law states, “The driver of a vehicle approaching an intersection shall yield the right-of-way to a vehicle which has entered the intersection from a different highway.” Similarly, when a driver intends to make a left turn, he or she must “yield the right-of-way to any vehicle approaching from the opposite direction which is within the intersection or so close thereto as to constitute an immediate hazard.”
In short, a driver may be liable for a T-bone accident if he or she (1) ran a red light, (2) failed to yield to a car already in the intersection, or (3) made a left turn in front of another vehicle. When a driver violates a traffic law and injures someone else, it is considered “negligence per se” under Nevada law. Unless the defendant can provide sufficient evidence their actions were justified or excusable under the circumstances, negligence per se proves the defendant breached a “duty of care,” which is a critical element of any personal injury claim.

But ignoring traffic laws are not the only grounds for establishing a driver’s negligence in a T-bone accident.
