What Options Do I Have for Getting Paid After an Accident?

Because Nevada is an at-fault state, drivers who cause crashes are responsible for paying for them. While this often works to the advantage of those who are wrongfully injured, it does not work in the event that the at-fault driver is uninsured or uninsured, providing the injured party with few options for recovering the compensation that they truly deserve. If you are involved in a crash with a driver who does not have insurance, a few of your options for recovering compensation include:

• Filing an insurance claim with your own insurance. Hopefully, you have purchased uninsured/underinsured motorist coverage as part of your own policy. While this type of coverage is not required, it is highly recommended, and helps to pay for the costs of your medical expenses, as well as any of your passengers’ medical expenses, in the event that the driver who hits you does not have (enough) insurance. In addition to uninsured/underinsured coverage to pay for medical expenses, your own policy’s medical payments coverage (also optional) can help to cover the costs of your injuries, and your policy’s collision coverage can help to pay for the costs of vehicle repairs.
• Filing a claim with your health insurance. If you have health insurance, your health insurance policy can be used to help pay for the cost of your medical expenses up to your policy amount. Keep in mind that most health insurance policies require you to pay a deductible first – in some cases, the deductible alone can be thousands of dollars.
• Filing another type of claim for compensation. In some cases, you may be able to pursue compensation through other areas. For example, if you are disabled from your accident and unable to work, Social Security Disability Insurance may help by providing you with monthly payments. Or, if your car accident happened while you were performing a work-related activity, workers’ compensation insurance may be applicable.
• Filing a lawsuit against the at-fault driver or another negligent party. Finally, you have the right to file a lawsuit directly against the at-fault party. If the driver who hit you did not have insurance, however, this may be an indication that they do not have the financial means to pay for your injuries even if your lawsuit is successful. Other parties against whom a suit may be filed might include a third party driver, or a vehicle (parts) manufacturer if a vehicle defect caused or contributed to the accident.
