Generally speaking, bike riders and drivers must both obey the laws of the road and also share the roadway (unless it has specifically marked bike lanes). So if a bike rider and a motorist are involved in an accident, the bike rider must show two things in order to collect damages in a personal injury lawsuit.

This fatal accident occurred just one day after a three-motorcycle pile-up in Las Vegas. According to Nevada Highway Patrol officials, the September 19 motor bike crash briefly closed the southbound lanes of Interstate 15 just north of Speedway Boulevard. The trio of motorcyclists was taken to a nearby hospital, but their conditions and identities were unknown.

I want to send my heartfelt condolences to the family of the motor bike rider and I hope the passenger is able to pull through, though their life may never be the same. This was a terrible accident and illustrates the risks associated with riding a motorcycle.

Negligent drivers aren’t the only ones who have a duty of care. Car manufacturers also owe a duty of care to those who will be using their cars, trucks, SUVs, and motorcycles on public roads. This duty of care extends to the person who purchases the vehicle and to anyone inside the vehicle when a serious accident occurs. But this legal duty of care also extends to anyone else who suffers a serious injury as a result of someone driving a defective vehicle.

I understand the temptation to take your motor bike out on Interstate 15 (I-15), I-215, or maybe even the Vegas strip for a ride without a helmet; the wind whipping through your hair and the sun shining on your face, but this is extremely dangerous. As mentioned earlier in the post, you’re nine times more likely to get hurt on a motorcycle in an accident. Don’t take that risk.
