PARADISE TRUCK ACCIDENT ATTORNEY

Type of Truck Accidents

Paradise, Nevada may be less well known to visitors, but as the home of the University of Nevada, McCarran International Airport addition, and numerous hotels and casinos, it gets more than its share of traffic. In addition to residents, students, and tourists commuting throughout the area, drivers find themselves sharing the road with numerous semi-trucks and tractor trailers making commercial deliveries. Cars are no match for these big rigs when it comes to being involved in an accident, and the injuries sustained are often severe. When you are involved in a truck accident, our Paradise injury attorneys are here to provide the professional legal representation you need, defending your interests against the trucking companies and their insurers so you can get the compensation you need to recover.

According to the Federal Motor Carrier Safety Administration (FMCSA), there are nearly 4,000 driver fatalities each year as the result of truck accidents, while as many as 90,000 others suffer serious injuries At Naqvi Injury Law, we represent those injured in the following types of truck accidents:

`

  • Rollover Accidents: These accidents are often related to truck driver errors, such as failing to properly navigate turns or approaching turns at too high a speed, or as the result of improper loading and securing of cargo.
  • Side Swipe Accidents: These occur when a truck driver switches lanes suddenly, into the path of another vehicle. The driver may not have looked before attempting to change lanes, or may have failed to account for motorists in their blind spot.
  • T-Bone Collisions: These collisions often occur as the result of driver inattention or due to reckless driving behaviors such as speeding or running red lights.
  • Rear End Collisions: These can result from poor truck maintenance, such as faulty brake systems, or as the result of the truck driver’s failure to respond to changes in traffic flow.
  • Head On Collisions: This happens when a truck leaves its own lane and crashes head-first into oncoming traffic. These collisions may be due to driver inexperience or unfamiliarity with traffic patterns, particularly around exit and entrance ramps, or as the result of driving under the influence or falling asleep behind the wheel.

In any of the above crashes, the truck driver has the size and bulk of their vehicle to protect them.  Unfortunately, it is often other motorists who suffer the most severe and potentially life threatening harm.

Proving Fault in a Truck Accident

The National Highway Traffic Safety Administration (NHTSA) states that the majority of trucking accidents are due to errors on the part of the truck driver, problems with cargo, or poor truck maintenance. While the reasons may seem obvious, you will still need to prove your case.

This involves collecting police and traffic reports, statements from witnesses at the scene, and video footage from nearby traffic lights or businesses. Photos should be taken where the accident occurred, and you may need to consult with an accident reconstruction expert.

All of this can be difficult to do on your own, particularly when recovering from serious injuries. At Naqvi Injury Law, we have the knowledge and resources needed to build a strong case on your behalf, ensuring your best chance for success.

Proving Fault in a Truck Accident

When an accident occurs, it can be difficult to determine who is to blame, and in many cases, an investigation will need to be opened in order to figure out exactly what went wrong. In all cases, however, if a driver neglects their duty of care to operate their vehicle in a reasonably safe and careful manner, and if this act of negligence causes the crash, this driver can be held liable for any damages that result. This means that if you have been involved in an accident caused by a driver guilty of any of the actions above, you can seek damages directly from this driver to compensate you for your medical bills, pain, suffering, lost wages, property damage, and any other economic and noneconomic expenses you have suffered.

How to Start the Claims Process after an Aggressive Driver Hits You

If you are involved in a crash with an aggressive driver, you have three options for recovering damages: you may file a claim with the insurance of the at-fault driver, file a claim with your own insurance (which you may do if you have collision coverage, MedPay coverage, or UM/UIM coverage), or file a lawsuit directly against the other driver. To begin the claims process, be sure to contact your insurance company as soon as possible after your crash to report the accident. If the insurance company asks you to give a recorded statement, refrain from doing so until you have spoken with an attorney.

What to Do When Offered a Settlement

When a truck accident occurs, you will likely be dealing with the trucking company, rather than the driver. These companies have deep pockets, and even if you prove fault in your case, their insurers may attempt to deny or undervalue your claim. If you accept a settlement, you will be forfeiting your right to further compensation.

Before accepting any offers, contact our experienced injury attorneys first. We can negotiate with the trucking company and their insurers on your behalf, and assist you in getting the maximum amount you will need to recover. In the event a settlement cannot be reached, you may be entitled to compensation through a personal injury lawsuit, with damages including medical expenses, lost wages, and pain and suffering.
